Information Collected

In general, you can visit this Web site located at www.barbaconsulting.com (“Site”) provided by Barba Consulting, Inc. and/or its parent, affiliate and subsidiary companies (collectively, “Barba,” “us,” or “we”) without telling us who you are or revealing any information about yourself. This Privacy Policy Agreement (“Policy”) addresses Barba’s practices regarding information collected from users of the Site and only addresses information collected directly through or from the Site – it does not address or govern any information gathering, use, or dissemination practices related to information collected from the user (sometimes referred to as a “visitor,” “you” or “your”) other than directly through or from the Site, such as from telephone, facsimile, postal mail, personal delivery, or other or additional offline means or media. Our web servers may collect or track the home server domain names, date and time of your visit, type of computer, the originating IP address, files downloaded, search engine used, operating system, and type of Web browser of visitors to the Site as well as aggregate and user-specific information regarding which pages a user accesses.

 

Our web servers may place a “cookie” (a small data file) or similar code on your computer’s hard drive which allows the server to determine the computer when it visits again, in order to track statistical information about navigation to and throughout certain areas of our Site and the Internet, and to allow Barba to serve advertisements and promotions to you on other third party Web sites.

 

Specifically Barba (1) engages third party vendors, including Google, to display advertisements on third party Web sites on the Internet; (2) third party vendors, including Google, use cookies to serve advertisements based on your prior visits to our Site; and (3) you may opt out of Google’s use of cookies by visiting the Google advertising opt-out page.  In addition, you can opt out of a third party’s vendor’s use of cookies by visiting the Network Advertising Initiative and/or by placing the appropriate setting on your browser to reject or disable cookies.

 

This Site may use Remarketing Dynamic Ads, a feature that uses the Teracent cookie and you may opt out of the Teracent cookie by visiting the Teracent opt-out page.

 

This Site may use DoubleClick’s remarketing pixels, and you may opt out of DoubleClick’s use of your cookies by visiting the DoubleClick opt-out page or the Network Advertising Initiative opt-out page (as also listed above).

 

 

Please note that if you disable cookies entirely, you may limit your browsing experience on the Internet. Such cookies are not used by Barba to obtain your name or any personal data.

 

Barba may use Google Analytics, or a similar tracking service later developed, in order to gather, store, and track certain information related to your visit to and activity on the Site.

 

Barba may utilize an opt-in Geolocation service in accordance with a prevailing community standard such as HTML 5. Such Geolocation opt-in ability is managed by the user’s browser settings. If a user chooses to opt-in to the Geolocation service, the user’s use of the Site, comments and other activities on the Site may be associated with the user’s location, both internally within Barba and publicly on the Site.

 

In addition, there are parts of this Site where we may need to collect personal information from you for a specific purpose, such as to provide you with certain information or services you request, including processing payments made on the Site and accessing and viewing your screen in connection with our webinars and related services. The information collected from you may include your name, address, telephone, fax number, e-mail address, billing address and related payment information, as well as information knowingly provided by you in online forms, surveys, e-mail, and other online avenues (including, without limitation, demographic and personal profile data). If you do not provide all the information needed by us we may not be able to give you the information or services you request.

 

Use of Collected Information

 

Aggregated data on visitors’ home servers that we collect is not used to personally identify you and instead is aggregated to measure statistical use of the Site, such as the number of visits, average time spent on the Site and pages viewed for internal purposes. We use this information to measure the use of our Site and to improve the content of our Site.

 

We do not share, sell, or lease personal information about you provided through the Site to any third-parties for their marketing use. Personal information collected by Barba, such as your name and e-mail address, may be used by Barba for many reasons, for example, to respond to your inquiry or to process your request (such as to receive investor relations materials or inquiry about employment), for recordkeeping, editorial and feedback purposes, marketing and promotional purposes, statistical analysis of users’ behavior, product development, content improvement, or to customize the content and layout of the Site. We may share your personal information with our current or future subsidiaries or affiliates in order to enable us to do so. For this purpose, the information you provide may be transferred outside your country to another country that does not have similar data protection legislation and may provide a lower level of protection for your information. However, we have taken certain measures outlined below to try to protect the security of your information. By submitting any information you consent to these transfers. We may also share your personal information with other companies we have hired to provide services for us, including housing your financial information with a third party payment processor we may engage. These companies – our vendors – are contractually bound to use personal information we share with them only to perform the services we have hired them to provide. While Barba may undertake efforts to see that any third party to whom Barba discloses personal information is under an obligation to use the personal information solely for the purposes for which the information was disclosed, such third parties are independent third parties over which Barba exercises no control. Barba is not responsible for, and will not be liable for, the conduct, actions, omissions, or information handling or dissemination practices of third parties.

 

We will release information about you if you direct us to do so, if we are required by law to do so, or in other legally limited circumstances (for example, to protect your account from fraud). Identifiable and non-identifiable visitor information and data may be disclosed or distributed to another party with which Barba enters or reasonably may enter into a corporate transaction, such as, for example, a merger, consolidation, acquisition, or asset purchase, or to a third party pursuant to a subpoena, court order, or other form of legal process, in response to a request by or on behalf of any local, state, federal, or other government agency, department, or body, whether or not pursuant to a subpoena, court order, or other form of legal process, or if determined by Barba in its sole judgment that such disclosure or distribution is appropriate to protect the life, health, or property of Barba or any other person or entity.

 

As a benefit to registered users of the Site, Barba may include a users name and relevant personal information in his or her profile. If you are or become registered on the Site, you agree that your name and certain registration information provided to Barba may be made publicly available on the Site through your profile. You have the right to specify whether certain other personal information in your profile is publicly available or not. From time to time, we may need to contact you for member-related activities (e.g., renewal notices, etc.). You agree that we may use your personal information for such membership-related contacts with you. We may also desire to contact you for market research purposes or to provide you with other marketing information we think would be of particular interest. You will have the option of not being contacted by Barba and opting-out of such contacts by setting the appropriate option in your profile.

 

Without limiting the foregoing, Barba reserves the right (but has no obligation) to monitor all communications posted to the Site, including through any ratings or messaging functions and other general areas of the Site. Such voluntary information posted by you may be collected and used by Barba in accordance with this Privacy Statement. 

 

Privacy of Children

 

The Site is not intended for children under the age of 13. It does not knowingly collect personal information online from visitors in this age group. We do not knowingly solicit or collect personal information from or about visitors in this age group, and we do not knowingly market our products or services to children. All users must be at least 18 years of age in order to use the Site.

 

Links to Other Sites

 

Barba’s’ Site may contain links to other third party web sites and, while we try to link only to Sites that share our high standards and respect for privacy, we are not responsible for the content, security, or privacy practices employed by other web sites.  Such other web sites are not subject to this Policy and it is your sole obligation to review and understand the privacy practices and policies of these other web sites.

 

Security of Collected Information

 

We implement physical, electronic, and administrative safeguards designed to protect your personal information from unauthorized or inappropriate access.  Despite our efforts to protect your personal information, the Internet is not a secure medium and there is always a risk that an unauthorized third party may circumvent such procedures or that transmissions of your information over the Internet may be intercepted. The confidentiality of any communication or material transmitted to or from Barba via this Site or via e-mail cannot be and is not guaranteed.  Accordingly, Barba is not responsible for the security of information transmitted via the Internet. Instead of communicating with Barba via e-mail or the Internet, visitors can contact Barba by telephone at 856-985-0500. We attempt to restrict access to information about you to those Barba workers who need to know the information to respond to your inquiry or request. Workers who misuse personal information may be subject to disciplinary action.

 

In addition, to protect your personal information, never share your password with anyone, and if you feel that your password has been discovered, you should change it immediately by logging on to the Site and accessing your profile to change your password or by contacting us at info@barbaconsulting.com.

 

Opt-Out Right

 

Except as necessary for Barba to provide the services, products or information, requested by a user of the Site, you may opt out of having your personally identifiable information, which has been voluntarily provided to Barba through the Site, prospectively retained by Barba, used by Barba for secondary purposes, or disclosed by Barba to third parties by using any opt-out features that may be provided on the Site or by contacting us and requesting to opt-out of such use.  (This does not apply to collection of the type of Web browser of the visitor to the Site or to non-identifiable visitor information provided or collected.)

Any materials or comments, including blog posts to any of our Web pages are public. Please refer to the “Information Provided by You” section of the Terms and Conditions for further detail concerning User Content and other materials submitted to the Site. As such, Barba assumes no liability for the accuracy of such information, no duty to update or correct such information, and no liability for such communications arising under the laws of copyright, libel, privacy, obscenity, or otherwise.
